1. ACKNOWLEDGMENT OF RISK & RELEASE OF LIABILITY
Member acknowledges that participation in strength training, powerlifting, conditioning, cardiovascular exercise, turf training, classes, open gym use, and special events involves inherent and significant risks including equipment malfunction, falling weights, improper spotting, slipping, overexertion, illness exposure, permanent disability, or death.
Member knowingly and voluntarily assumes all such risks, both known and unknown.
Member releases, indemnifies, and holds harmless Forge 26 Fitness, its owners, officers, employees, contractors, instructors, affiliates, and agents from any claims arising from injury, disability, death, or property damage.
This release expressly includes claims based upon the alleged ordinary negligence of Forge 26 Fitness to the fullest extent permitted under Pennsylvania law. This release does not apply to gross negligence or willful misconduct.
2. 24/7 UNSTAFFED FACILITY ACKNOWLEDGMENT
Forge 26 operates as a 24/7 key-access facility and is not continuously staffed.
Member understands that exercising in an unstaffed facility increases risk due to lack of supervision and immediate emergency response. Member agrees to call 911 in case of emergency and assumes all risks associated with unstaffed access.
3. MEMBER CODE OF CONDUCT
Forge 26 maintains a zero-tolerance policy for harassment, intimidation, inappropriate behavior, disruptive conduct, threats, or illegal activity.
Forge 26 reserves the right to immediately suspend or terminate membership without refund for unsafe or inappropriate conduct. Forge 26 may cooperate with law enforcement and issue trespass notices when appropriate.
4. VIDEO SURVEILLANCE CONSENT
Member acknowledges that video surveillance is in use throughout the facility (excluding private areas such as restrooms) for safety and security purposes.
Member consents to recording and acknowledges footage may be used for safety investigations, disciplinary action, law enforcement cooperation, and legal defense.
5. PROPERTY DAMAGE
Member agrees to use equipment properly and safely.
Member is financially responsible for damage caused by misuse, negligence, or intentional acts. Forge 26 may charge the payment method on file for repair or replacement costs after written notice.
6. GUEST RESPONSIBILITY
Member assumes full responsibility for any guest admitted into the facility and agrees to indemnify Forge 26 for claims arising from guest conduct.
Unauthorized admission of non-members may result in membership termination.
7. MEDIA & PHOTO RELEASE
Forge 26 may photograph or record video within the facility for lawful promotional purposes including marketing, website, event, or social media use.
By signing this Agreement, Member grants Forge 26 an irrevocable, perpetual, royalty-free right to use Member’s image, likeness, or appearance captured within the facility for promotional purposes. No compensation shall be provided.
Member may opt out by submitting a written request to management. Forge 26 will make reasonable efforts to avoid future promotional use of that Member’s image.
For Members under 18, a parent or legal guardian must execute this release.
8. MEMBERSHIP BILLING & PAYMENT AUTHORIZATION
Member authorizes recurring electronic payments.
A $15 late fee applies to accounts unpaid 10 days past due.
If Member defaults, Member agrees to pay all collection costs including agency fees, court costs, and reasonable attorney fees.
Member agrees not to initiate a chargeback without first providing written notice and allowing 10 business days for resolution.
Improper chargebacks constitute breach of this Agreement. Member agrees to reimburse Forge 26 for all chargeback fees, administrative costs, and attorney fees incurred.
9. MEMBERSHIP CANCELLATION POLICY
Membership is month-to-month and continues until properly cancelled.
Cancellation must be submitted through:
1. The Member’s online portal;
2. Written email to Forge 26 management; or
3. Written notice delivered during staffed hours.
Verbal requests, social media messages, or third-party notice do not constitute valid cancellation.
Cancellation becomes effective at the end of the current billing cycle following proper notice. No partial month refunds will be issued.
Failure to properly cancel does not relieve Member of payment obligations.
Initiating a credit card dispute in lieu of properly cancelling constitutes breach of this Agreement and may result in collection action and recovery of administrative fees.
10. FREEZE POLICY
Member may freeze membership for up to 90 days with 7-day written notice.
Temporary closures due to events beyond control (fire, flood, natural disaster, government order) will result in membership freeze until reopening. Refunds are not required for temporary closures.
11. TERMINATION RIGHTS
Forge 26 reserves the right to terminate membership at any time for nonpayment, policy violations, safety concerns, or conduct detrimental to the facility.
No refund is required in cases of termination for misconduct or policy violation.
12. FACILITY CLOSURE
In the event of permanent closure, Forge 26 will refund the prorated unused portion of prepaid membership time.
13. ARBITRATION & VENUE
Any dispute arising from this Agreement shall be resolved exclusively through binding arbitration in Butler County, Pennsylvania under the rules of the American Arbitration Association.
Member waives the right to trial by jury.
14. ELECTRONIC SIGNATURE
Electronic execution of this Agreement constitutes a binding signature under the Pennsylvania Uniform Electronic Transactions Act.
15. MINOR MEMBERS
Members under 18 must have a parent or legal guardian execute this Agreement.
Parent/guardian assumes full responsibility for the minor’s participation and agrees to indemnify Forge 26 for claims arising from minor activity.
ACKNOWLEDGMENT
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS, AND SIGN IT FREELY AND VOLUNTARILY.
